These Terms of Use are entered into by and between you and Canal Side Family Dental (collectively, “we,” “us,” or the “Practice”).
The Practice is a 42 North Dental Care, PLLC practice and is owned and operated by dentists Dr. Samuel Shames, DMD. and Dr. Ronald Weissman, DMD. The Practice is supported by 42 North Dental, LLC, a dental support organization that provides non-clinical administrative and business support services to the practice. 42 North Dental, LLC does not own or operate the dental practice or employ dentists to provide dental services. The following terms, together with the Privacy Policy which is incorporated by reference (collectively, the “Terms of Use”), govern your access to and use of the Website.
“You” and similar terms means you as an individual, as well as the business or entity on whose behalf you are using the Website, and you represent and warrant that you are authorized to enter into this agreement on behalf of yourself and such business or entity. Indemnification

YOU FURTHER AGREE THAT ANY DISPUTE RESOLUTION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ACTIONS ARE NOT PERMITTED AND YOU AGREE TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION OR ANY SIMILAR COLLECTIVE LEGAL ACTION. YOU WILL PURSUE ANY CLAIM OR DISPUTE REGARDING THE PRACTICE IN YOUR INDIVIDUAL CAPACITY AND NOT AS PART OF A CLASS ACTION OR COLLECTIVE ACTION.
ANY CLAIM BY YOU MUST BE RAISED WITHIN TWELVE (12) MONTHS FROM THE DATE ON WHICH THE CLAIM AROSE OR IT IS WAIVED AND VOID.
Miscellaneous
Under no circumstances will we be held liable for any delay or failure in performance due in whole or in part to any acts of nature or other causes beyond our reasonable control.
If any provision of these Terms of Use is found to be unlawful or unenforceable, then that provision will be deemed severable from these Terms of Use and will not affect the enforceability of any other provisions.
The failure by us to enforce any right or provision of these Terms of Use will not prevent us from enforcing such right or provision in the future.
